1. Acceptance of Terms

4. Rewards Program

The Scentwork rewards program allows you to earn rewards based on qualifying purchases made through your unique marketing codes and links.

4.1 Qualification

Rewards are earned only on qualifying purchases that:

• Are completed and paid in full
• Pass fraud detection and KYC verification checks
• Are not refunded, cancelled, or charged back
• Comply with our Marketing Code of Conduct

4.2 48-Hour Approval Window

4.3 Compliance

All marketing and promotional activities must comply with applicable laws and our Marketing Code of Conduct. Violations may result in forfeiture of rewards, account suspension, or termination.

5. Prohibited Activities

You agree not to:

• Violate any applicable laws, regulations, or these Terms
• Engage in fraudulent or deceptive practices
• Make false or misleading claims about products or the rewards program
• Make income, health, or therapeutic claims about products
• Spam, harass, or engage in unethical marketing practices
• Use automated systems to manipulate rewards or create fake accounts
• Attempt to circumvent fraud detection or security measures
• Reverse engineer, decompile, or attempt to access the Service's source code
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purpose

6. Intellectual Property

The Service and its content, including but not limited to text, graphics, logos, images, software, and trademarks, are owned by Scentwork or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.

7. User Content

You retain ownership of any content you submit, post, or share through the Service ("User Content"). By submitting User Content, you grant Scentwork a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and promoting the Service.

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our policies
• Fraudulent or illegal activity
• Non-compliance with applicable laws or regulations
• Prolonged inactivity

Upon termination, your right to use the Service will immediately cease, and any pending rewards will be forfeited.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any content or information provided through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENTWORK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the greater of $100 or the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Scentwork and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or third-party rights
• Your User Content or marketing activities

12. Dispute Resolution

Any dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
